Informed consent and the disclosure of risks of treatment: the Supreme Court of Canada decides

Two 1980 decisions on informed consent by the Supreme Court of Canada are discussed. The court found the duty of disclosure of risks to be based in negligence and not battery. The physician's duty to disclose "material risks" was held to include some nonmedical elements related to the patient's questions and "reasonable" needs.
