This paper explores whether we can interpret the notion of ‘forensic culture’ as something akin to what Knorr-Cetina called an ‘epistemic culture’. Can we speak of a ‘forensic culture’, and, if so, how is it similar to, or different from, other epistemic cultures that exist in what is conventionally called ‘science’? This question has important policy implications given the National Academy Science’s (NAS) recent identification of ‘culture’ as one of the problems at the root of what it identified as ‘serious deficiencies’ in U.S. forensic science and ‘scientific culture’ as an antidote to those problems. Finding the NAS’s characterisation of ‘scientific culture’ overly general and naïve, this paper offers a preliminary exploration of what might be called a ‘forensic culture’. Specifically, the paper explores the way in which few of the empirical findings accumulated by sociologists of science about research science seem to apply to forensic science. Instead, forensic science seems to have developed a distinct culture for which a sociological analysis will require new explanatory tools. Faithful sociological analysis of ‘forensic culture’ will be a necessary prerequisite for the kind of culture change prescribed by external reformist bodies like the NAS.  相似文献

This essay examines how crime dramas produced during, and since, the 1990s became marked by the quest for ‘forensic realism’. In particular, the essay traces a landmark shift in the development of forensic realism in the form of the ground-breaking British police drama Prime Suspect in 1991. It is argued that this television series not only represents a turning point in television history, but that it also constitutes a key text in the broader cultural turn towards forensic fascination. Prime Suspect vividly revealed and displayed corpses, crime scenes and post-mortem photos in an unprecedented fashion for television. This essay shows how in the process it established new standards and expectations regarding the aesthetics and thematic content of the perceived ‘realism’ of the crime genre. Through an analysis of the reception and impact of Prime Suspect the essay also demonstrates how crime drama’s increasing fascination with forensic realism has driven debate over just what kinds of stories and images constitute acceptable or appropriate subject matter for popular entertainment, and for the medium of television itself.  相似文献

This paper utilizes the framework of Karl Popper’s 3-world ontology to make the case that forensic science is a specialized coding system that establishes meaningful connections between the world of biology (world 1) and the world of human society (world 3). Forensic science is a cross-disciplinary endeavor that uses scientific methods to determine what transpired in a crime so the legal system can determine how to prosecute the offender(s). On a Popperian analysis of forensic science, world 1 consists of evidence gathered at the crime scene, which enables investigators to develop a detailed reconstruction of the incident for consideration under the legal and ethical codes of society, which are products of world 3. Understanding forensic science in this way serves two purposes: first, it extends Marcello Barbieri’s code biology into the realm of philosophical considerations in science, law and ethics; and second, it situates forensic science within the larger context of debates in contemporary philosophy of science.  相似文献

ABSTRACT  Forensic science has come to be assigned an important role in contemporary crime fiction. In this article, I analyze the cultural repertoire of forensic science conveyed by the popular television show Crime Scene Investigation (CSI). I argue that CSI science, in delivering an absolute "truth" about how and by whom crimes have been committed, is equated with justice, effectively superseding nonfictional forensic science as well as nonfictional judicature as a whole. Thus, CSI as a cultural performance adds to the mediascape a repertoire of wishful-thinking science with which to think about perceptions of and desires for crime and justice in nonfictional society. This repertoire seems to be considered relevant enough to nonfictional society to cause concern about the judicial system, as expressed in discussions of the so-called " CSI effect."  相似文献

"Tell a story," my mother instructs her graduate students as they prepare their talks. I will make use of her advice here, and will tell several short stories. The themes revolve around the practice of science-what motivates us to go into science and how we choose questions once we get there. I also touch on progress in scientific tools, teaching, good mentors, and good colleagues, all of which contribute to making a career in science constantly compelling.  相似文献

This is an account of ethnographic research examining the specialist scientific processes known as ‘Disaster Victim Identification’ (DVI) in three settings: Québec, the United States, and the United Kingdom. In cases of multiple deaths, a series of actions accompanied by a plethora of tools are often invoked, housed at a disaster scene, forensic laboratories, a family assistance centre, and a mortuary. In this article, I examine a process dedicated to connecting the biological remains of the deceased with a confirmed validation of personhood. I describe a situation where responders/scientists will attempt multiple testing and re-testing of human remains, often pushing boundaries of available science. I argue that the search for certainty in identification lies at the heart of the activation of DVI processes, particularly when it is connected to DNA testing. Observing intimate forensic settings and the bricolage of the forensic anthropologist's labour has allowed me to track the production of the science of identity. I then reflect on the wider implications of these observations for affected communities and the responding scientists. Finally, I argue that there is complexity and ambivalence surrounding the increased use of technologies when applied to identification of victims.  相似文献

Though there is a burgeoning interest in applied Buddhist ethics, Buddhist animal research ethics remains an underdeveloped area. In this paper I will explore how some central Buddhist ethical considerations can usefully engage our use of other animals (henceforth, animals) in science. As the scientific use of animals is broad, I will narrow my focus to laboratory science. I will show that, though a Buddhist abolitionism would not be unmotivated, it is possible to reject it. While doing so, it will be important to resist emphasizing elements of Buddhist thought that merely provide reasons to adopt the dominant ethical framework governing laboratory animal research ethics, known as the 3Rs. Though I will suggest how a Buddhist animal research ethics can sometimes permit the use of animals in harmful research, it will also require ethical constraints that resonate with some of the more progressive elements in ‘Western’ bioethics.  相似文献

This paper explores how Melanesian villagers have harnessed modern, technological ways of seeing. It begins by analysing the politics and narrative structures of dreams and popular stories about secret photos concerning the dead. These are stories about losing control and regaining hidden, alternative representations of Melanesians. I then analyse how millenarian followers have experimented with ‘constructing’ their own versions of cameras, televisions and videos so as to gain access to the omniscient powers of modern technology and merge them with those of a Christian god and with the gaze of the dead. In the Pomio Kivung movement, ‘televisions' and ‘videos' have even been used to create new forms of moral surveillance for policing and governing communities. Here the customary shamanic worlds of dreams and possession have been modernised and redeployed to re‐mediate the governmental practices and disciplinary schemes of civilisating projects originally belonging to Western churches and government.  相似文献

ABSTRACT   In this article, I focus on the ways in which audiences in the Amazonian community of Gurupá respond to television's interpellation for pan-national identity. I examine how viewers heed, miss, ignore, and resist the call for identity as well as how their various responses to this "call" shape their worldview and behavior and impact the process of nation building. Utilizing audience ethnography over a 25-year period, I show in this study how televisual messages are contextualized and localized, mitigating the forces of nationalistic homogenization.  相似文献

Angela Potochnik’s Idealization and the Aims of Science (Chicago) defends an ambitious and systematic account of scientific knowledge: ultimately science pursues human understanding rather than truth. Potochnik argues that idealization is rampant and unchecked in science. Further, given that idealizations involve departures from truth, this suggests science is not primarily about truth. I explore the relationship between truths about causal patterns and scientific understanding in light of this, and suggest that Potochnik underestimates the importance and power of highly particular narrative explanations.  相似文献

This article challenges stereotypical conceptions of Law and Science as cultural opposites, arguing that English criminal trial practice is fundamentally congruent with modern science’s basic epistemological assumptions, values and methods of inquiry. Although practical tensions undeniably exist, they are explicable—and may be neutralised—by paying closer attention to criminal adjudication’s normative ideals and their institutional expression in familiar aspects of common law trial procedure, including evidentiary rules of admissibility, trial by jury, adversarial fact-finding, cross-examination and the ethical duties of expert witnesses. Effective partnerships between lawyers and forensic scientists are indispensable for integrating scientific evidence into criminal proceedings, and must be renegotiated between individual practitioners on an on-going basis. Fruitful interdisciplinary collaboration between scholars with a shared interest in forensic science should dispense with reductive cultural stereotypes of Science and Law.  相似文献

This paper examines claims made about the role of ‘expert knowledge’ in analysing the language of individuals seeking asylum in the UK. I treat policy as a type of power and seek to understand how this policy uses the language of science to further the British government's stated interest to provide ‘secure borders’ and a ‘safe haven’ for refugees. I look at how the Home Office defines, shapes and implements the policy, and at how the policy has influenced judicial decisions. In short I unmask UKBA's claim that it relies upon expert, scientific knowledge to assess asylum claims.  相似文献

A forensic capability to help identify perpetrators and exclude innocent people should be an integral part of a strategy against terrorist attacks. Exercises have been conducted to increase our preparedness and response capabilities to chemical, biological, radiological, and nuclear (CBRN) terrorist attacks. However, incorporating forensic components into these exercises has been deficient. CBRN investigations rely on forensic results, so the need to integrate a forensic component and forensics experts into comprehensive exercises is paramount. This article provides guidance for planning and executing exercises at local, state, federal, and international levels that test the effectiveness of forensic capabilities for CBRN threats. The guidelines presented here apply both to situations where forensics is only a component of a more general exercise and where forensics is the primary focus of the exercise.  相似文献

Many epistemological terms, such as investigation, inquiry, argument, evidence, and fact were established in law well before being associated with science. However, while legal proof remained qualified by standards of ‘moral certainty’, scientific proof attained a reputation for objectivity. Although most forms of legal evidence (including expert evidence) continue to be treated as fallible ‘opinions’ rather than objective ‘facts’, forensic DNA evidence increasingly is being granted an exceptional factual status. It did not always enjoy such status. Two decades ago, the scientific status of forensic DNA evidence was challenged in the scientific literature and in courts of law, but by the late 1990s it was being granted exceptional legal status. This paper reviews the ascendancy of DNA profiling, and argues that its widely-heralded objective status is bound up with systems of administrative accountability. The ‘administrative objectivity’ of DNA evidence rests upon observable and reportable bureaucratic rules, records, recording devices, protocols, and architectural arrangements. By highlighting administrative sources of objectivity, this paper suggests that DNA evidence remains bound within the context of ordinary organisational and practical routines, and is not a transcendent source of ‘truth’ in the criminal justice system.  相似文献

Ludwik Fleck’s theory of thought-styles has been hailed as a pioneer of constructivist science studies and sociology of scientific knowledge. But this consensus ignores an important feature of Fleck’s epistemology. At the core of his account is the ideal of ‘objective truth, clarity, and accuracy’. I begin with Fleck’s account of modern natural science, locating the ideal of scientific objectivity within his general social epistemology. I then draw on Fleck’s view of scientific objectivity to improve upon reflexive accounts of the origin and development of the theory of thought-styles, and reply to objections that Fleck’s epistemological stance is self-undermining or inconsistent. Explicating the role of scientific objectivity in Fleck’s epistemology reveals his view to be an internally consistent alternative to recent social accounts of scientific objectivity by Harding, Daston and Galison. I use these contrasts to indicate the strengths and weaknesses of Fleck’s innovative social epistemology, and propose modifications to address the latter. The result is a renewed version of Fleck’s social epistemology, which reconciles commitment to scientific objectivity with integrated sociology, history and philosophy of science.  相似文献

Anthropologists working at ‘home’ or in realms of the familiar often share a considerable sense of connection with participants. In these contexts, the researcher's potential position as an ‘insider’ offers particular opportunities for utilising self as a key resource. Through my own fieldwork at ‘home’ in Melbourne as an ‘insider’ among Bosnian migrants, I was confronted with the challenge of using my self to understand others' experiences. In this paper I discuss the autoethnographic process and consider how its application enabled me to consciously understand my own experiences and utilise my experiential self to inform my study.  相似文献

In 1916, a 41 year old woman with little formal scientific education became the secretary of the New York Aquarium (NYA). In becoming the Aquarium’s first female officer, Ida M. Mellen realized her lifelong dream of successfully pursuing a career in the biological sciences and broke with the limitations and low expectations surrounding her sex and class backgrounds. By 1930, Mellen left the NYA and pursued a career in popular hobbyist writing, becoming the foremost expert on aquarium fishes and domesticated cats in the United States. Margaret Rossiter and other historians of science have illuminated women’s common career paths in the sciences, but little work has been done on individuals whose gender and class impacted their career. Building on Rossiter’s framework, this case study suggests that class, as much as gender, structured the scientific career of women. Through the narrative of the outsider scientific practitioner, we can more fully illuminate the social structure of scientific work. Examining the struggles of Mellen to enter and maintain a scientific career sheds light, not just on her own career path, but those alternately closed to her. If we wish to understand science in the early twentieth century, especially questions of inclusion and exclusion in the scientific process, we must examine those individuals who operated on the periphery of the “traditional” scientific path.  相似文献

Understanding how scientific activities use naming stories to achieve disciplinary status is important not only for insight into the past, but for evaluating current claims that new disciplines are emerging. In order to gain a historical understanding of how new disciplines develop in relation to these baptismal narratives, we compare two recently formed disciplines, systems biology and genomics, with two earlier related life sciences, genetics and molecular biology. These four disciplines span the twentieth century, a period in which the processes of disciplinary demarcation fundamentally changed from those characteristic of the nineteenth century. We outline how the establishment of each discipline relies upon an interplay of factors that include paradigmatic achievements, technological innovation, and social formations. Our focus, however, is the baptism stories that give the new discipline a founding narrative and articulate core problems, general approaches and constitutive methods. The highly plastic process of achieving disciplinary identity is further marked by the openness of disciplinary definition, tension between technological possibilities and the ways in which scientific issues are conceived and approached, synthesis of reductive and integrative strategies, and complex social interactions. The importance--albeit highly variable--of naming stories in these four cases indicates the scope for future studies that focus on failed disciplines or competing names. Further attention to disciplinary histories could, we suggest, give us richer insight into scientific development.  相似文献
