Since passage of the Clean Water Act in 1972, there has been a long, unresolved struggle to define a key phrase in Section 316(b) of the act: "adverse environmental impact" (AEI). Section 316(b) requires that the best technology available be used in cooling-water intake structures to minimize AEI due to entrainment and impingement of aquatic organisms. Various attempts were made to evaluate and define AEI, including focused national conferences on impact assessment. Unresolved arguments regarding AEI were reinvigorated following the 1995 Consent Decree requiring EPA to propose new rules to implement Section 316(b). This article reviews and compares eight proposed definitions of AEI. Six of the definitions define AEI as impact expressed at the population or higher level of biological organization. The two remaining definitions are unrelated to populations: a 1% cropping of the near-field organisms and "one fish equals AEI". The latter definition is based on the desire of some stakeholders to define AEI as the loss of any public trust resources. Equating loss of public trust resources with AEI hampers consensus on a definition because a societal-based policy concept (public trust resources) is commingled with science-based definitions based on population effects. We recommend that a population-based definition of AEI be incorporated into Section 316(b) guidance and observe that this will not preclude a state from exercising its law and policy to protect public trust resources.  相似文献

The withdrawal of water from the nation's waterways to cool industrial facilities kills billions of adult, juvenile, and larval fish each year. U.S. Environmental Protection Agency (EPA) promulgation of categorical rules defining the best technology available to minimize adverse environmental impact (AEI) could standardize and improve the control of such mortality. However, in an attempt to avoid compliance costs, industry has seized on the statutory phrase "adverse environmental impact" to propose significant procedural and substantive hurdles and layers of uncertainty in the permitting of cooling-water intakes under the Clean Water Act. These include, among other things, a requirement to prove that a particular facility threatens the sustainability of an aquatic population as a prerequisite to regulation. Such claims have no foundation in science, law, or the English language. Any nontrivial aquatic mortality constitutes AEI, as the EPA and several state and federal regulatory agencies have properly acknowledged. The focus of scientists, lawyers, regulators, permit applicants, and other interested parties should not be on defining AEI, but rather on minimizing AEI, which requires minimization of impingement and entrainment.  相似文献

Section 316(b) of the Clean Water Act requires that cooling-water intake structures (CWIS) use Best Technology Available (BTA) to minimize adverse environmental impacts (AEI). The U.S. EPA has not defined AEI, and there is no clear consensus regarding its definition. Nonetheless, operational definitions are necessary to evaluate design alternatives and to measure the success of mitigative measures. Rather than having to develop measures of aquatic health that are highly site-specific, controversial, and often unlikely to elicit agreement from all sides of the environmental "fence", " it may be more productive to use existing ecological assessment tools. Aquatic Life Uses (ALU) already provide a regulatory framework to assess the quality (health) of the aquatic community in various habitats (e.g., warmwater habitat, exceptional warmwater habitat). Attainment of the ALU indicates that further point source controls are unnecessary, whereas nonattainment indicates that those pollutants or stressors causing the nonattainment must be reduced. A similar approach for existing water intakes is recommended. That is, attainment of the designated ALU will be taken as an indication that there is no AEI. Although attainment of the ALU may not be a foolproof indicator of a lack of AEI, this approach seems more reasonable that using scarce monetary resources to fix problems that likely do not exist, or having both regulators and the regulated community expend their resources debating whether various observed biological responses do or do not constitute AEI.  相似文献

The electric utility industry has developed an approach for decisionmaking that includes a definition of Adverse Environmental Impact (AEI) and an implementation process. The definition of AEI is based on lessons from fishery management science and analysis of the statutory term "adverse environmental impact" and is consistent with current natural resource management policy. The industry has proposed a definition focusing on "unacceptable risk to the population"s ability to sustain itself, to support reasonably anticipated commercial or recreational harvests, or to perform its normal ecological function." This definition focuses not on counting individual fish or eggs cropped by the various uses of a water body, but on preserving populations of aquatic organisms and their functions in the aquatic community. The definition recognizes that assessment of AEI should be site-specific and requires both a biological decision and a balancing of diverse societal values. The industry believes that the definition of AEI should be implemented in a process that will maximize the overall societal benefit of the paragraph 316(b) decision by considering the facility"s physical location, design, and operation, as well as the local biology. The approach considers effects on affected fish and shellfish populations and the benefits of any necessary best technology available (BTA) alternatives. This is accomplished through consideration of population impacts, which conversely allows consideration of the benefits of any necessary BTA modifications. This in turn allows selection of BTAs that will protect potentially affected populations in a cost-effective manner. The process also employs risk assessment with stakeholder participation, in accordance with EPA's Guidelines for Ecological Risk Assessment. The information and tools are now available to make informed decisions about site-specific impacts that will ensure protection of aquatic ecosystems and best serve the public interest.  相似文献

This paper develops a comparative framework for policy proposals involving fish protection and Section 316(b) of the Clean Water Act (CWA). Section 316(b) addresses the impingement and entrainment of fish by cooling-water intake structures used principally by steam electric power plants. The framework is motivated by examining the role of adverse environmental impacts (AEIs) in the context of Section 316(b) decision making. AEI is mentioned in Section 316(b), but not defined. While various AEI options have been proposed over the years, none has been formalized through environmental regulations nor universally accepted. Using a multiple values approach from decision analysis, AEIs are characterized as measurement criteria for ecological impacts. Criteria for evaluating AEI options are identified, including modeling and assessment issues, the characterization of ecological value, regulatory implementation, and the treatment of uncertainty. Motivated by the difficulties in defining AEI once and for all, a framework is introduced to compare options for 316(b) decision making. Three simplified policy options are considered, each with a different implicit or explicit AEI approach: (1) a technology-driven rule based on a strict reading of the 316(b) regulatory text, and for which any impingement and entrainment count as AEI, (2) a complementary, open-ended risk-assessment process for estimating population effects with AEI characterized on a site-specific basis, and (3) an intermediate position based on proxy measures such as specially constructed definitions of littoral zone, sensitive habitat, or water body type. The first two proposals correspond roughly to responses provided, respectively, by the Riverkeeper environmental organization and the Utility Water Act Group to the U.S. Environmental Protection Agency (EPA)'s proposed 316(b) new facilities rule of August 2000; the third example is a simplified form of the EPA's proposed August 2000 new facilities rule itself. The simplified policy positions are compared using the three dimensions of the comparative policy framework: (1) the role of CWA philosophy or vision, such as the use of technology-forcing rules, (2) regulatory policy implementation, and (3) the role for scientific information and the knowledge base. Strengths and weaknesses of all three 316(b) policy approaches are identified. The U.S. EPA's final new facilities rule of November 2001 is briefly characterized using the comparative policy framework and used to further illustrate the approach.  相似文献

Anemonia elastase inhibitor (AEI) is a "nonclassical" Kazal-type elastase inhibitor from Anemonia sulcata. Unlike many nonclassical inhibitors, AEI does not have a cystine-stabilized alpha-helical (CSH) motif in the sequence. We chemically synthesized AEI and determined its three-dimensional solution structure by two-dimensional NMR spectroscopy. The resulting structure of AEI was characterized by a central alpha-helix and a three-stranded antiparallel beta-sheet of a typical Kazal-type inhibitor such as silver pheasant ovomucoid third domain (OMSVP3), even though the first and fifth half-cystine residues forming a disulfide bond in AEI are shifted both toward the C-terminus in comparison with those of OMSVP3. Synthesized AEI exhibited unexpected strong inhibition toward Streptomyces griseus protease B (SGPB). Our previous study [Hemmi, H., et al. (2003) Biochemistry 42, 2524-2534] demonstrated that the site-specific introduction of the engineered disulfide bond into the OMSVP3 molecule to form the CSH motif could produce an inhibitor with a narrower specificity. Thus, the CSH motif-containing derivative of AEI (AEI analogue) was chemically synthesized when a Cys(4)-Cys(34) bond was changed to a Cys(6)-Cys(31) bond. The AEI analogue scarcely inhibited porcine pancreatic elastase (PPE), even though it exhibited almost the same potent inhibitory activity toward SGPB. For the molecular scaffold, essentially no structural difference was detected between the two, but the N-terminal loop from Pro(5) to Ile(7) near the putative reactive site (Met(10)-Gln(11)) in the analogue moved by 3.7 A toward the central helix to form the introduced Cys(6)-Cys(31) bond. Such a conformational change in the restricted region correlates with the specificity change of the inhibitor.  相似文献

Study of the etiologic spectrum of sporadic cases of causative agents of acute enteric infections (AEI) in 753 patients aged 15-85 years old using polymerase chain reaction (PCR) was performed in the infectious diseases hospital during 12 months. It was shown that detection of the causative agents of AEI by PCR was 2.2 times more effective than routine microbiologic diagnostics supplemented with test of feces on rotavirus by ELISA method and allowed to detect etiologic agent in 54.3% of the patients. Viral etiology of AEI was determined in 22.6% of the patients. The most significant causative agents of AEI comparable on the rate of detection with salmonella and shigella were genotype 2 noroviruses and group A rotaviruses which were isolated in 10.4 and 8.9% of the patients respectively. Seasonal change of dominating viral pathogens causing diarrheal diseases was noted: predominance of group A rotaviruses during winter-spring period, noroviruses--during spring-summer months, and astroviruses--during fall and in the beginning of winter.  相似文献

Recently, it was found that excess phosphorus (Pi) removal could be achieved in activated sludge with an aerobic/extended‐idle (AEI) process. In this study, batch tests were performed to further reveal the inducing mechanism of Pi removal involved in the AEI process. Unlike the classical anaerobic/aerobic process where an anaerobic Pi release along with a significant polyhydroxyalkanoate (PHA) accumulation drives polyphosphate (poly‐P) accumulating organisms (PAOs) to over‐store Pi as poly‐P, an idle Pi release accompanied by a low‐idle PHA production, which is usually considered to be detrimental for biological Pi removal, was observed to induce some cells to effectively uptake Pi in excess of metabolic requirement in the AEI process. With the increase of idle Pi release, Pi removal efficiency linearly increased. The results also showed that a long idle period with a low level of intracellular glycogen could significantly increase Pi release contents, thus remarkably enhancing Pi removal performances. Fluorescence in situ hybridization analysis further revealed that activated sludge in the AEI process contained 37.6% of Accumulibacter (PAOs) and 28.2% of Competibacter and Defluviicoccus‐related organisms (glycogen accumulating organisms). This study revealed an actually existent, yet previously unrecognized, inducing mechanism of poly‐P accumulation, and this mechanism behind the AEI regime may provide a scientific basis for the development of an alternative strategy for Pi removal from wastewaters. The clinical observation of patients with acute enteric infections (AEI), treated with loading doses of Bifidumbacterin forte during the first 2 days of the disease, was carried out. The preparation was shown to produce a positive effect on the course of AEI: salmonellosis, alimentary toxicoinfections, acute, dysentery. The early decrease of the manifestations of intoxication, pain syndrome, diarrhea, as well as the acceleration of convalescence in comparison with standard treatment, were noted. The most essential dynamics was registered in salmonellosis patients. The analysis of clinical results allowed to recommend the use of loading doses of Bifidumbacterin forte, a probiotic with high colonization potential to normalize the microbiocenosis of the intestine in AEI.  相似文献

EEG recording has been used to evaluate in cats the effect of naloxone on acute ethylic intoxication (AEI). Naloxone was administered both before and during the course of AEI. Results of the experiment showed that administration of naloxone before the AEI potentiates the toxic effect of alcohol. However, the administration of naloxone in a continuous way along the course of AEI significantly diminished the toxic effect of alcohol.  相似文献

Materials on the organization and realization of prophylactic measures with respect to acute enteric infections (AEI) and viral hepatitis A (VHA) at the period of the liquidation of medico-sanitary consequences of the high flood are presented. As shown in these materials, the epidemiological surveillance on AEI and VHA in the areas affected by the emergency situation included the effective system of monitoring on these diseases. On the basis of monitoring optimum decisions were taken and concrete prophylactic measures were realized. This made it possible to detect the foci of infectious diseases in due time and efficiently liquidate them, as well as to prevent the development of the epidemiological consequences of the high flood.  相似文献

Quantitative antigen dose-neutralizing antibody response curves were established in guinea pigs for purified foot-and-mouth disease virus (FMDV), type A, strain 119, inactivated for 48 hr with N-acetylethyleneimine (AEI). Inactivation of FMDV by 0.05% AEI at 25 C occurred without virus degradation and followed first-order kinetics over a 10(8)-fold decrease in plaque-forming units (PFU) extrapolating to 10(-5) PFU/ml at 48 hr. The AEI-treated virus was administered in doses ranging from 10 ng to 2.62 mg, alone or emulsified in oil adjuvant. Sigmoidal dose-response curves were obtained with 160 ng as the minimum effective dose. The maximum effective dose was 163 mug and 2.62 mg or more at 6 and 28 through 84 days postinoculation, respectively. Oil adjuvant had little effect at 6 days postinoculation, but its use markedly increased the amount of neutralizing antibody obtained at the later testing periods.  相似文献

The fecal microflora of patients with acute enteric infections (AEI) has been examined on the territory of the Moscow region. The pathogens of high, moderate and low priority levels have been detected. As revealed in this study, shigellae, salmonellae, enteropathogenic and enteroinvasive Escherichia are the etiological agents of bacterial diarrheas on the territory of the Moscow region. We evaluated the impacts of entrainment and impingement at the Salem Generating Station on fish populations and communities in the Delaware Estuary. In the absence of an agreed-upon regulatory definition of "adverse environmental impact" (AEI), we developed three independent benchmarks of AEI based on observed or predicted changes that could threaten the sustainability of a population or the integrity of a community. Our benchmarks of AEI included: (1) disruption of the balanced indigenous community of fish in the vicinity of Salem (the "BIC" analysis); (2) a continued downward trend in the abundance of one or more susceptible fish species (the "Trends" analysis); and (3) occurrence of entrainment/impingement mortality sufficient, in combination with fishing mortality, to jeopardize the future sustainability of one or more populations (the "Stock Jeopardy" analysis). The BIC analysis utilized nearly 30 years of species presence/absence data collected in the immediate vicinity of Salem. The Trends analysis examined three independent data sets that document trends in the abundance of juvenile fish throughout the estuary over the past 20 years. The Stock Jeopardy analysis used two different assessment models to quantify potential long-term impacts of entrainment and impingement on susceptible fish populations. For one of these models, the compensatory capacities of the modeled species were quantified through meta-analysis of spawner-recruit data available for several hundred fish stocks. All three analyses indicated that the fish populations and communities of the Delaware Estuary are healthy and show no evidence of an adverse impact due to Salem. Although the specific models and analyses used at Salem are not applicable to every facility, we believe that a weight of evidence approach that evaluates multiple benchmarks of AEI using both retrospective and predictive methods is the best approach for assessing entrainment and impingement impacts at existing facilities.  相似文献

During acute and early human immunodeficiency virus type 1 (HIV-1) infection (AEI) more than 50% of CD4+ T cells are preferentially depleted from the gastrointestinal (GI) lamina propria. To better understand the underlying mechanisms, we studied virological and immunological events within the peripheral blood (PB) and GI tract during AEI. A total of 32 AEI subjects and 18 uninfected controls underwent colonic biopsy. HIV-1 viral DNA and RNA levels were quantified in CD4+ T cells derived from the GI tract and PB by using real-time PCR. The phenotype of infected cells was characterized by using combinations of immunohistochemistry and in situ hybridization. Markers of immunological memory, activation, and proliferation were examined by flow cytometry and immunohistochemistry, and the host-derived cytotoxic cellular response was examined by using immunohistochemistry. GI CD4+ T cells harbored, on average, 13-fold higher HIV-1 viral DNA levels and 10-fold higher HIV-1 RNA levels than PB CD4+ T cells during AEI. HIV-1 RNA was detected in both "activated" and "nonactivated" mucosal CD4+ T cells. A significantly higher number of activated and proliferating T cells were detected in the GI tract compared to the PB, and a robust cytotoxic response (HIV-1 specificity not determined) was detected in the GI tract as early as 18 days postinfection. Mucosal CD4+ T-cell depletion is multifactorial. Direct viral infection likely accounts for the earliest loss of CD4+ T cells. Subsequently, ongoing infection of susceptible CD4+ T cells, along with activation-induced cellular death and host cytotoxic cellular response, are responsible for the persistence of the lesion.  相似文献

Equivalent loss models encompass a variety of life table-based approaches that can be used to convert age- and life stage-specific estimates of entrainment and impingement loss to a common, easily understood currency. This common currency can be expressed in terms of numbers of individuals, yield to the fishery, or biomass to the ecosystem. These models have at least two key uses in the Section 316(b) assessment process: screening for adverse environmental impact (AEI) and determination of environmental benefits associated with intake alternatives. This paper reviews the various forms of equivalent loss models, their data input requirements, and their assumptions and limitations. In addition, it describes how these models can be used as a second-level screening tool as part of the assessment of the potential for AEI. Given their relative simplicity and ease of use, equivalent loss models should prove to be an important tool in the arsenal of impact assessment methods for Section 316(b).  相似文献

Environmental consultants are in a unique position to address the practical aspects of a working definition of "adverse environmental impact" (AEI) within Section 316(b) of the Clean Water Act. In our work with the electric utility industry, attorneys, and regulatory agencies, we have encountered numerous and sometimes conflicting interpretations as to what constitutes AEI. In our over 30 years of experience, we have applied most of the approaches suggested for addressing this issue, including biostatistical methods, trend analysis, time series methods, conditional mortality rate models, stock-recruitment models, equivalent adult models, and ecosystem models. In our experience, the paradigm most helpful in bringing about agreement among stakeholders is to (1) create a model of operating scenarios, (2) use empirical data from on-site studies to parameterize the model, (3) convert losses by life stage to equivalent adult losses, (4) convert equivalent adult losses to economic value, and (5) compare scenarios on an economic basis.  相似文献
