Patenting antibodies in Europe

As a complement to the series of articles beginning in this issue on obtaining, maintaining and enforcing antibody patents in the United States, this article provides a comparison of the requirements for patenting antibodies in the United States and Europe and provides examples illustrating the application of European patent law to antibodies.     

Three new species of penicillium

Three new species of microfungi belonging to the genus Penicillium Link ex Fries are described and illustrated. All but one have been isolated from the atmosphere of las Palmas, capital city of the island of Gran Canaria (Canary Islands, Spain). They clearly differ from all species of the genus described so far and are, therefore, described and proposed as new species: Penicillium hispanicum sp. nov., Penicillium grancanariae sp. nov., and Penicillium palmensis sp. nov.     

Patenting the products of genetic engineering

Until the most recent times, products of nature were unpatentable, not as failing to qualify as a manufacture for which patent protection may be sought under 35 U.S.C. §101, but because they were mere isolates of natural products. Genetically engineered microorganisms (e.g., Chakrabarty's plasmid-injected oil eatingPseudomonas) and biologically pure cultures of wild strains (e.g., Bergy'sStreptomyces which produces the antibiotic lincomycin) open uncharted waters in patent law.     

Patenting inventions arising from biological research

Patents are the most important way in which researchers can protect the income that might come from ideas or technologies they have developed. This article describes the steps involved and the considerations needed for successful granting of a patent. For instance, inventions must be novel and not obvious, adequately described, and useful, and they should not be disclosed publicly before a patent is applied for.     

Isolation of alkaloid-like substances from penicillium fungi]

Alkaloid-like substances have been obtained from the cultivation of fungi Penicillium granulatum and Penicillin corylophillum. The procedure for their preparative isolation has been developed. They do not have physico-chemical characteristics typical of alkaloids viridicatine and cyclopenine, previously isolated from Penicillium fungi. The presence of nitrogen in the structure has been shown in the product synthesized by Penicillium granulatum. Ultraviolet, infrared, nuclear magnetic resonance and mass spectra have been recorded for the product.     

Synthesis of steroidal lactone by penicillium citreo-viride

The biotransformations of a series of steroids by the fungus penicillium citreo-viride A.C.C.C. 0402 have been investigated, and the conversion to the same product testolactone (1) was observed from progesterone (2), dehydroepiandrosterone (3), 4-androstene-3, 17-dione (4), 5-androstene-3, 17-diol (5) with the exception of pregnenolone (6) and 3beta-hydroxy-5, 16-pregnadien-20-one (7). The possible metabolic pathways of the biotransformations were also discussed in the paper and the fungus penicillium citreo-viride A.C.C.C. 0402 was isolated during screening stains from samples collected from Zhengzhou, Henan province of China.     

Patenting genome research tools and the law

Patenting genes encoding therapeutic proteins was relatively uncontroversial in the early days of biotechnology. Controversy arose in the era of high-throughput DNA sequencing, when gene patents started to look less like patents on drugs and more like patents on scientific information. Evolving scientific and business strategies for exploiting genomic information raised concerns that patents might slow subsequent research. The trend towards stricter enforcement of the utility and disclosure requirements by the patent offices should help clarify the current confusion.
