The author describes the events surrounding his attempts to lecture on the subject of euthanasia in West Germany in June 1989. Singer, who defends the view that active euthanasia for some newborns with handicaps may be ethically permissible, had been invited to speak to professional and academic groups. Strong public protests against Singer and his topic led to the cancellation of some of his engagements, disruptions during others, and harrassment of the German academics who had invited him to speak. These incidents and the subject of euthanasia became matters of intense national debate in West Germany, but there was little public or academic support for Singer's right to be heard. Singer argues that bioethics and bioethicists must have the freedom to challenge conventional moral beliefs, and that the events in West Germany illustrate the grave danger to that freedom from religious and political intolerance.  相似文献

This article concentrates on the care for people who suffer from progressive dementia. Dementia has a great impact on a person’s well‐being as well as on his or her social environment. Dealing with dementia raises moral issues and challenges for participants, especially for family members. One of the moral issues in the care for people with dementia is centred on responsibilities; how do people conceive and determine their responsibilities towards one another? To investigate this issue we use the theoretical perspective of Margaret Walker. She states that ideas about identity play a crucial role in patterns of normative expectations with regard to the distribution of responsibilities in daily practices of care. The results of this study show how the identity of a family‐member is put under pressure and changes during her loved one’s illness that leads to difficulties and misunderstandings concerning the issue of responsibility. These results offer an insight into the complexities of actual practices of responsibility and highlight the importance for those caring for people with dementia of attending carefully to how they see themselves and how they see other people involved (Who am I? Who do I want to be for the other?). Answers to such questions show what people expect from themselves and from one another, and how they, at any rate, are distributing responsibilities in a given situation. Professional caregivers should take into account that family members might have different ideas about who they are and consequently about what their responsibilities are.  相似文献

In a climate marked by expanding scholarship in ethnic and racial studies alongside sweeping changes in universities and the conditions of academic work, we seek to explore the nature of and challenges for critically engaged research, teaching and scholarship on race and racism. In particular, we look at the connection between academic scholarship and political engagement and activity that we are calling race critical public scholarship. We situate the discussion within various recent debates about universities and ‘publics’, and the public orientation and reach of academic work. We set out three frames for these issues: the impact of social movements in establishing race and racism as legitimate topics of academic investigation and setting the agenda for race research; the differing role of academics as public intellectuals and scholar-activists in addressing and engaging with publics and race issues; and the scope and limits of public sociology in addressing the responsibilities and institutionalized power of the academy. We argue that each of these frames offers a partial insight, but that further work is needed based on cases and examples that explore the facility for and challenges of undertaking race critical scholarship.  相似文献

This article presents data drawn from a confidential, voluntary survey conducted the week after September 11, 2001, at a large, state-funded Midwestern university, asking university faculty to describe the ways they engaged with students in their classrooms in the wake of the events. Acknowledging the charges against academics by some who felt faculty had abused their responsibilities as teachers and public intellectuals, we recast the debate over the political nature of faculty classroom strategies by setting the questions raised by critics, and by faculty responses to the survey, in the context of the development of mass education in the United States.  相似文献

Alberto Giubilini and Francesca Minerva's controversial article ‘After‐Birth Abortion: Why Should the Baby Live?’ has received a lot of criticism since its publishing. Part of the recent criticism has been made by pro‐life philosopher Christopher Kaczor, who argues against infanticide in his updated book ‘Ethics of Abortion’. Kaczor makes four arguments to show where Giubilini and Minerva's argument for permitting infanticide goes wrong. In this article I argue that Kaczor's arguments, and some similar arguments presented by other philosophers, are mistaken and cannot show Giubilini and Minerva's view to be flawed. I claim that if one wants to reject the permissibility of infanticide, one must find better arguments for doing so.  相似文献

A recent article reassessing the Neutral Theory of Molecular Evolution claims that it is no longer as important as is widely believed. The authors argue that “the neutral theory was supported by unreliable theoretical and empirical evidence from the beginning, and that in light of modern, genome‐scale data, we can firmly reject its universality.” Claiming that “the neutral theory has been overwhelmingly rejected,” they propose instead that natural selection is the major force shaping both between‐species divergence and within‐species variation. Although this is probably a minority view, it is important to evaluate such claims carefully in the context of current knowledge, as inaccuracies can sometimes morph into an accepted narrative for those not familiar with the underlying science. We here critically examine and ultimately reject Kern and Hahn's arguments and assessment, and instead propose that it is now abundantly clear that the foundational ideas presented five decades ago by Kimura and Ohta are indeed correct.  相似文献

Many critics of commercial surrogate motherhood argue that it violates the rights of children. In this paper, I respond to several versions of this objection. The most common version claims that surrogacy involves child‐selling. I argue that while proponents of surrogacy have generally failed to provide an adequate response to this objection, it can be overcome. After showing that the two most prominent arguments for the child‐selling objection fail, I explain how the commissioning couple can acquire parental rights by paying the surrogate only for her reproductive labor. My explanation appeals to the idea that parental rights are acquired by those who have claims over the reproductive labor that produces the child, not necessarily by those who actually perform the labor. This account clarifies how commercial surrogacy differs from commercial adoption. In the final section of the paper, I consider and reject three further child‐based objections to commercial surrogacy: that it establishes a market in children's attributes, that it requires courts to stray from the best interests standard in determining custodial rights, and that it requires the surrogate to neglect her parental responsibilities. Since each of these objections fails, children's rights probably do not pose an obstacle to the acceptability of commercial surrogacy arrangements.  相似文献

This paper challenges the view that bans on kidney sales are unjustifiably paternalistic, that is, that they unduly deny people the freedom to make decisions about their own bodies in order to protect them from harm. I argue that not even principled anti‐paternalists need to reject such bans. This is because their rationale is not hard paternalism, which anti‐paternalists repudiate, but soft paternalism, which they in principle accept. More precisely, I suggest that their rationale is what Franklin Miller and Alan Wertheimer call ‘group soft paternalism’. Group soft paternalistic policies restrict the freedom of autonomous individuals, not for their own good (hard paternalism), but as an unavoidable consequence of seeking to protect other, non‐autonomous individuals from harms that they have not voluntarily chosen (soft paternalism). Group soft paternalism supports prohibiting kidney sales on three conditions: (1) that such sales are potentially harmful to vendors, (2) that many vendors would suffer impaired autonomy, and (3) that distinguishing between autonomous and non‐autonomous vendors and interfering only with the latter is unfeasible. I provide reasons for thinking that these conditions will often hold.  相似文献

Abstract

Japan is an island nation which is heavily dependent upon the surrounding seas for food, importation of raw materials, exportation of finished products, and for national security. Japan is also the world's largest fishing and shipping nation, which poses certain problems and imposes special responsibilities on her. Japan has traditionally followed the principle of freedom of the high seas, but under the external pressure of developments at UNCLOS III and unilateral actions by other states, Japan has been forced to accept and accommodate herself to the new concept of transit passage through international straits, the twelve nautical mile territorial sea, and the two hundred nautical mile exclusive economic zone, which were perceived as contrary to her national interests. However, Japan is adapting to the new ocean regime that is emerging from both customary and conventional international law, because she has confidence that a stable regime is more important in the long run than some short‐term advantages that might be obtained through the absence of any regime. Furthermore, as one of the highly developed nations of the world, Japan feels a special responsibility to play an effective role in aiding and assisting the developing nations of the world.  相似文献

Jurgen Habermas has argued that carrying out pre‐natal germline enhancements would be inimical to the future child's autonomy. In this article, I suggest that many of the objections that have been made against Habermas' arguments by liberals in the enhancement debate misconstrue his claims. To explain why, I begin by explaining how Habermas' view of personal autonomy confers particular importance to the agent's embodiment and social environment. In view of this, I explain that it is possible to draw two arguments against germline enhancements from Habermas' thought. I call these arguments ‘the argument from negative freedom’ and ‘the argument from natality’. Although I argue that many of the common liberal objections to Habermas are not applicable when his arguments are properly understood, I go on to suggest ways in which supporters of enhancement might appropriately respond to Habermas' arguments.  相似文献

In my commentary on Francesca Minerva's article ‘New Threats to Academic Freedom’, I agree with her contention that the existence of the Internet has given rise to new and very serious threats to academic freedom. I think that it is crucial that we confront those threats, and find ways to eliminate them, which I believe can be done. The threats in question involve both authors and editors. In the case of authors, I argue that the best solution is not anonymous publication, but publication using pseudonyms, and I describe how that would work. In the case of editors, my proposal is a website that a number of journals would have access to, where papers that editors judge to be clearly worthy of publication, but whose publication seems likely to set off a firestorm of public and media protest, could be published without any indication of the journal that had accepted the paper for publication.  相似文献

This article examines how Mongolian Buddhist monks view the freedom they have experienced since the fall of Soviet socialism in 1990. Whereas the anthropological literature on postsocialism tends to focus on political and economic transformations, I argue that contemporary Mongolian politics points to the coexistence and interdependence of human and nonhuman agents. The article highlights how, in the context of the country's current mining boom, postsocialist politics requires attention to contemporary religious practices and spiritual beings beyond the ‘secular’. Considering emerging forms of Buddhist environmentalism, I describe how the freedom projects of Mongolian monks crystallize the intersection of Soviet socialist materialism, neoliberal individualism, and a Buddhist ethics of self‐transformation.  相似文献

This article explores the nature of inter‐ethnic asymmetry and the dynamic of long‐term dependence in Amazonia. Drawing on the case of the Sanema and their neighbouring Ye'kwana, it seeks to gain a deeper understanding of submission and indebtedness with a view to rethinking where the power might lie in such relationships. The association between the two groups, I argue, is motivated by the Sanema's pursuit of manufactured items, access to which the Ye'kwana had historically monopolized. The dynamic entered into in order to procure these goods is one of voluntary deference on the part of the Sanema, a demeanour that is actively pursued because it enables morally valued autonomy and a freedom from ongoing reciprocity. I conclude that this ‘submissive extraction’ can offer new perspectives on the relationship between debt, predation, and freedom.  相似文献

Using a specific case as an example, the article argues that the Internet allows dissemination of academic ideas to the general public in ways that can sometimes pose a threat to academic freedom. Since academic freedom is a fundamental element of academia and since it benefits society at large, it is important to safeguard it. Among measures that can be taken in order to achieve this goal, the publication of anonymous research seems to be a good option.  相似文献

We developed a method to facilitate maternal care in a giant panda (Ailuropoda melanoleuca) female that rejected her cub immediately after parturition. After removal of the cub, the female was systematically exposed to a regime of infant‐related stimuli, including a surrogate toy panda, accompanied by infant vocalizations and urine, and the mother's own milk. The female displayed several measures of maternal behavior toward the surrogate, for example, spending 61% of her time holding the surrogate in positions typical for the species. There was some evidence that maternal proficiency increased across the 4 weeks of the experiment. Results also indicate that the female was responsive to both infant vocalizations and urine, but not milk. After a transitional period in which we assisted the female in her efforts to nurse and groom the infant, all maternal care‐giving responsibilities were returned to the mother. Over the next 3 months, the pattern of maternal care followed the species‐typical course of declining mother‐infant contact, grooming, overall interaction time, and responsiveness to the cub's vocalizations. This study marks the first successful reunification of a giant panda mother with an infant separated at birth and, it is hoped, will serve as a model for similar efforts elsewhere. The concept of parenthood needs to be redefined in relation to the new uses of sexuality and reproduction. Exclusively from the view of point of personal freedom, a “parent” is any person who has chosen to define himself/herself in this way with reference to the existence of another individual, whoipso facto benefits from this same freedom, limiting his/her own freedom. Although the world has experienced remarkable progress in health care since the last half of the 20th century, global health inequalities still persist. In some poor countries life expectancy is between 37‐40 years lower than in rich countries; furthermore, maternal and infant mortality is high and there is lack of access to basic preventive and life‐saving medicines, as well a high prevalence of neglected diseases, HIV/AIDS, tuberculosis, and malaria. Moreover, globalization has made the world more connected than before such that health challenges today are no longer limited within national or regional boundaries, making all persons equally vulnerable. Because of this, diseases in the most affluent countries are closely connected with diseases in the poorest countries. In this paper, we argue that, because of global health inequalities, in a situation of equal vulnerability, there is need for global solidarity not only as a means of reducing health inequalities, but also as a way of putting up a united force against global health challenges. We argue for an African approach to solidarity in which the humanity of a person is not determined by his/her being human or rational capacity, but by his/her capacity to live a virtuous life. According to this view of solidarity, because no one is self‐sufficient, no individual can survive alone. If we are to collectively flourish in a world where no individual, nation or region has all the health resources or protection needed for survival, we must engage in solidarity where we remain compassionate and available to one another at all times.  相似文献

The actions of pregnant women can cause harm to their future children. However, even if the possible harm is serious and likely to occur, the law will generally not intervene. A pregnant woman is an autonomous person who is entitled to make her own decisions. A fetus in‐utero has no legal right to protection. In striking contrast, the child, if born alive, may sue for injury in‐utero; and the child is entitled to be protected by being removed from her parents if necessary for her protection. Indeed, there is a legal obligation for health professionals to report suspected harm, and for authorities to protect the child's wellbeing. We ask whether such contradictory responses are justified. Should the law intervene where a pregnant woman's actions risk serious and preventable fetal injury? The argument for legal intervention to protect a fetus is sometimes linked to the concept of ‘fetal personhood’ and the moral status of the fetus. In this article we will suggest that even if the fetus is not regarded as a separate person, and does not have the legal or moral status of a child, indeed, even if the fetus is regarded as having no legal or moral status, there is an ethical and legal case for intervening to prevent serious harm to a future child. We examine the arguments for and against intervention on behalf of the future child, drawing on the example of excessive maternal alcohol intake.  相似文献

Although fields such as industrial ecology have advanced our understanding of how cleaner technologies, recycling, and lifestyle changes can reduce the impacts of production and consumption on people and planet, environmental deterioration and social injustices stubbornly persist. New strategies are needed to achieve change in an era of increasing urgency. This paper proposes that academics study the supply chains of individual corporations and link them to environmental and social impacts in geographically specific areas. Nongovernmental organizations (NGOs) have used this approach successfully, issuing reports about corporate activity related to deforestation, sweatshops, and other issues of social concern. But academics, by and large, have studied generic products, industries, and sectors. To verify this, after reviewing approximately 11,000 studies on supply chains, we identified just 27 academic papers that focused on individual corporations. These were primarily by NGOs and social scientists, with no studies by industrial ecologists meeting our review criteria. To uncover corporate supply chains, researchers used two distinct methodological approaches: in situ (interviews, surveys, and surveillance) and ex situ (trade data, document analysis, and maps). In this paper, we explain why and how academics should study the supply chains of individual corporations. This is done by combining approaches from industrial ecology, with those from geography, sociology, and other social sciences to develop a political‐industrial ecology of supply chains. This both physically links actual product flows with their environmental impacts, and explores how they affect justice, equity, and welfare. The work we propose offers clear collaborative linkages with NGOs, industry, and the media.  相似文献
