Article 100 of the UN Convention on the Law of the Sea requires parties to “cooperate” against maritime piracy, but how this cooperation is to be achieved is undefined. Enforcement is a public good—creating uncompensated benefits for others, thus suffering from free rider problems. The analysis in this article explains why more pirates captured are released than prosecuted, why the United Nations and the International Maritime Organization are seeking to reduce enforcement costs, why some in the shipping industry want to apply the 1988 Convention Against Terrorism at Sea, and why still others want to move prosecution of pirates from national courts to an international court.  相似文献

The pirates of Somalia pose a major challenge for the international community, both economically and morally. Somali pirates try to legitimize their actions by reference to a number of arguments that appeal to the international community. Allegedly, the illegal fishing and waste dumping in Somali waters were the triggers for piracy. Hence, the pirates want to protect their coasts. These various strands form the so-called legitimacy Robin Hood narrative. In this article, this narrative is critically examined. The analysis includes a discussion of justice theories and related claims based on the works of John Rawls and Thomas Pogge. This is followed by a discussion of the justification of violence using Nicholas Fotion's irregular just war theory.  相似文献

According to the Annual Reports of the International Maritime Bureau on Piracy and Armed Robbery Against Ships for calendar years 1998, 1999, and 2000, there has been a dramatic increase in the number of reported incidents of piracy and armed robbery against ships in waters in Southeast Asia, especially in the Malacca Strait and in Indonesian waters. Very few of the incidents in Southeast Asia are "piracy" as defined in international law because they took place in waters under the sovereignty of a coastal state. Nevertheless, many of the incidents posed serious threats to the safety of international maritime navigation. Some were offences under the 1988 Convention for the Suppression of Acts Against the Safety of International Maritime Navigation. Some were also major criminal hijacks involving international organized crime. There has been considerable action at both the global and regional levels to attempt to deal with this threat to the safety of international navigation. This article analyzes the reported incidents and the attempts by the international community to deal with the problem. The article concludes with various recommendations on steps that should be taken by the international community and States in Southeast Asia to combat piracy and armed robbery against ships.  相似文献

Field and laboratory studies were conducted to examine how territorial males of a Lake Tanganyika cichlid Telmatochromis vittatus balance the conflicting demands on nest choice between occupying large nests with more females and avoiding reproductive parasitism (nest piracy, which is adopted by the largest males in the population). Pirates less frequently intruded the nests farther from neighbours, perhaps due to the costs associated with travelling between nests. The field experiment showed that territorial male T. vittatus sacrificed the fitness benefits that large nests offer and instead prioritized occupying the nests farther from neighbours on which fewer pirates intruded. The field observations suggested that they adopt different strategies for nest choice according to their relative competitive ability to pirates; the large territorial males, who are size-matched to pirates and can defend their nests against them, compete for larger nests among the more-isolated nests, whereas subordinate territorial males, which are smaller than pirates and thus inferior to them, compete for the more-isolated nests among the less-isolated nests. These findings suggest that the territorial male T. vittatus chooses the more-isolated nests to avoid pirate males at the expense of occupying large nests.  相似文献

Much evidence suggests that life originated in hydrothermal habitats, and for much of the time since the origin of cyanobacteria (at least 2.5 Ga ago) and of eukaryotic algae (at least 2.1 Ga ago) the average sea surface and land surface temperatures were higher than they are today. However, there have been at least four significant glacial episodes prior to the Pleistocene glaciations. Two of these (approx. 2.1 and 0.7 Ga ago) may have involved a 'Snowball Earth' with a very great impact on the algae (sensu lato) of the time (cyanobacteria, Chlorophyta and Rhodophyta) and especially those that were adapted to warm habitats. The computerised databases of genetic fingerprints are laboratory tools and by extension law enforcement tools, for which the European Union has defined the applications. As these genetic profiles give no information on specific hereditary characteristics, these bases have been established in order to respect the rights and fundamental liberties of each individual. The seas of Southeast Asia play an important role in the economy of the surrounding countries. The region's constantly expanding coastal population and development has made great demands on marine resources, with growing evidence seen in the further degradation of the marine environment and continued exploitation of living as well as non-living resources. Integrated coastal area management has never been considered in the past while environmental protection measures and policies have largely been at local or national levels. Implementation of regional study programmes less than 10 years ago and ratification of international as well as regional agreements aimed at protecting the marine environment in recent times indicate a more enlightened approach to the problem.  相似文献

Towards an understanding of the Holocene distribution of Fagus sylvatica L.   总被引:1,自引:1,他引:1  
Aim Understanding the driving forces and mechanisms of changes in past plant distribution and abundance will help assess the biological consequences of future climate change scenarios. The aim of this paper is to investigate whether modelled patterns of climate parameters 6000 years ago can account for the European distribution of Fagus sylvatica at that time. Consideration is also given to the role of non‐climatic parameters as driving forces of the Holocene spread and population expansion of F. sylvatica. Location Europe. Methods European distributions were simulated using a physiologically‐based bioclimatic model (STASH) driven by three different atmospheric general circulation model (AGCM) outputs for 6000 years ago. Results The three simulations generally showed F. sylvatica to have potentially been as widespread 6000 years ago as it is today, which gives a profound mismatch with pollen‐based reconstructions of the F. sylvatica distribution at that time. The results indicate that drier conditions during the growing season 6000 years ago could have caused a restriction of the range in the south. Poorer growth conditions with consequently reduced competitive ability were modelled for large parts of France. Main conclusions Consideration of the entire European range of F. sylvatica showed that no single driving force could account for the observed distributional limits 6000 years ago, or the pattern of spread during the Holocene. Climatic factors, particularly drought during the growing season, are the likely major determinants of the potential range. Climatic factors are regionally moderated by competition, disturbance effects and the intrinsically slow rate of population increase of F. sylvatica. Dynamic vegetation modelling is needed to account for potentially important competitive interactions and their relationship with changing climate. We identify uncertainties in the climate and pollen data, as well as the bioclimatic model, which suggest that the current study does not identify whether or not climate determined the distribution of F. sylvatica 6000 years ago. Pollen data are better suited for comparison with relative abundance gradients rather than absolute distributional limits. These uncertainties from a study of the past, where we have information about plant distribution and abundance, argue for extreme caution in making forecasts for the future using equilibrium models.  相似文献

Around the world, many species are confined to “Sky Islands,” with different populations in isolated patches of montane habitat. How does this pattern arise? One scenario is that montane species were widespread in lowlands when climates were cooler, and were isolated by local extinction caused by warming conditions. This scenario implies that many montane species may be highly susceptible to anthropogenic warming. Here, we test this scenario in a montane lizard (Sceloporus jarrovii) from the Madrean Sky Islands of southeastern Arizona. We combined data from field surveys, climate, population genomics, and physiology. Overall, our results support the hypothesis that this species' current distribution is explained by local extinction caused by past climate change. However, our results for this species differ from simple expectations in several ways: (a) their absence at lower elevations is related to warm winter temperatures, not hot summer temperatures; (b) they appear to exclude a low‐elevation congener from higher elevations, not the converse; (c) they are apparently absent from many climatically suitable but low mountain ranges, seemingly “pushed off the top” by climates even warmer than those today; (d) despite the potential for dispersal among ranges during recent glacial periods (~18,000 years ago), populations in different ranges diverged ~4.5–0.5 million years ago and remained largely distinct; and (e) body temperatures are inversely related to climatic temperatures among sites. These results may have implications for many other Sky Island systems. More broadly, we suggest that Sky Island species may be relevant for predicting responses to future warming.  相似文献

While definitely not a new technology, mass spectrometry (MS) has seen incredible growth over the past 25 years. Mass spectrometry has rapidly evolved to the forefront of analytical techniques; its ability to analyze proteins is the major driving force in the field of proteomics. MS instrumentation has increased approximately 5-fold in sensitivity every three years. The level of performance that is achievable with MS today allows scientists to study proteins in ways that were inconceivable a quarter century ago. This review of the history of MS over the past 25 years is timely in that it encompasses two of the biggest developments, electrospray and matrix-assisted laser desorption/ionization (MALDI), which have enabled many of the uses of this technology today.  相似文献

The ancient renin-angiotensin system (RAS) was discovered more than a hundred years ago by identifying the rate-limiting enzyme of the system and its relevance to blood pressure regulation. Forty years ago, Detlev Ganten et al. postulated the existence of a tissue RAS. In these forty years, he kept developing the knowledge of these systems either directly or by training or attracting the interest of many researchers. Through the present review, we try to highlight recent advancements that originated from the postulation of local brain RAS. Although a large amount of knowledge accumulated, this system continues to intrigue and stimulate the interest and imagination of many researchers.  相似文献

Lamar Cave, a late Holocene paleontological site in Yellowstone National Park, USA, has yielded 36 fossil mammal species from 10 stratigraphic units representing about 2000 years. The fossil fauna is similar to the mammals in the park today and affords a unique opportunity to investigate paleocommunity and ecosystem dynamics through time.

Remains of an extralimital species in Yellowstone today, Microtus ochrogaster are found only in the oldest cave deposits, dated at 1695 ± 60 yr B.P. Disappearance of this species by about 1550 years ago marks evolution into the ecosystem that has persisted into the present and is recognizable by a fossil mammal assemblage that is virtually identical to the modern one. Relative abundance fluctuations in the mammal populations imply community resilience through the past 2000 years. Trends in relative abundances of small mammals, particularly the inverse relationship between Microtus and Spermophilus are interpreted as evidence of declining grass cover near Lamar Cave between approximately 1500 and 1000 years ago. The initiation of this environmental change may well have stimulated the ecosystem change marked by Microtus ochrogaster extirpation. Support for this hypothesis is found in a pollen record from a nearby lake.  相似文献

While most of the world has enjoyed exponential economic growth, more than one-sixth of the world is today roughly as poor as their ancestors were many generations ago. Widely accepted general explanations for the persistence of such poverty have been elusive and are needed by the international development community. Building on a well-established model of human infectious diseases, we show how formally integrating simple economic and disease ecology models can naturally give rise to poverty traps, where initial economic and epidemiological conditions determine the long-term trajectory of the health and economic development of a society. This poverty trap may therefore be broken by improving health conditions of the population. More generally, we demonstrate that simple human ecological models can help explain broad patterns of modern economic organization.  相似文献

One hundred years ago, Godfrey H. Hardy and Wilhelm Weinberg worked out, in independent publications, the formula that is regarded today as the elementary law for quantitative population genetics. In this article we describe the time period before the discovery of the Hardy–Weinberg law and try to illuminate the circumstances that surrounded its development. Because humans are the product of our evolutionary past, learning how we evolved is fundamental to all anthropological investigations. We now realize that reconstructing why unique human attributes evolved requires an understanding of our starting point, but this is a relatively recent perspective. One hundred years ago, the question of human origins was identical to that of hominin origins. Accepting Australopithecus into human ancestry, coupled with the modern synthesis of evolution, led anthropologists to consider humans as products of natural selection. They realized that increased intelligence did not initially distinguish our lineage, and that early hominins were apelike in many ways. Australopithecus brought bipedalityr and brain expansion came with Homo . Because the human mind and behavior are products of evolution, we must reconstruct the selective pressures that shaped our lineage in order to understand ourselves today. This article reviews China's responses to international piracy from the legal perspective by looking at China's treaty practices with regard to piracy suppression, China's enhanced overseas naval escort operations, China's domestic antipiracy law in both substantive and procedural aspects, and piracy prosecution under Chinese law. To aid in future efforts to accurately reconstruct the vertebrate tree, a quantitative measure of phylogenetic informativeness was applied to nucleotide and amino acid sequences for a set of 11 genes. We identified orthologues and assembled published fossil-calibrated divergence times between taxa that had been sequenced for each gene. Rates of molecular evolution for each site were estimated to characterize the molecular evolutionary pattern of genes and to calculate the phylogenetic informativeness. The fast-evolving gene albumin yielded the highest informativeness over the period from 60 million years ago to 500 million years ago. In contrast, calmodulin yielded the lowest informativeness, presumably because functional constraint minimized substitutions in the amino acid sequence. The gene c-myc showed an intermediate level of informativeness. The nucleotide sequence of cytochrome b showed extremely high utility for recent epochs, but low utility for times before 100 million years ago. We ranked nine other genes for their utility during the epochs of the divergence of the muroid rodents, early placental mammals, early vertebrates, and early metazoa, yielding results consistent with, but more precise than, previous studies. Interestingly, DNA sequence always exceeded amino acid sequence in informativeness over all time scales, yet support values were at best moderately higher. For epochs not subject to strong phylogenetic conflict due to convergence, we advocate gleaning the additional power of the threefold increase in number of characters that is present for DNA sequences over resorting to the less noisy but less informative amino acid sequences.  相似文献

The history of repeated inter- or transoceanic invasions in bivalve mollusks of the circumpolar Macoma balthica complex was assessed from mtDNA COIII sequences. The data suggest that four independent trans-Arctic invasions, from the Pacific, gave rise to the current lineage diversity in the North Atlantic. Unlike in many other prominent North Atlantic littoral taxa, no evidence for (postinvasion) trans-Atlantic connections was found in the M. balthica complex. The earliest branch of the mtDNA tree is represented by the temperate-boreal North American populations (=Macoma petalum), separated from the M. balthica complex proper in the Early Pliocene at latest. The ensuing trans-Arctic invasions established the North European M. b. rubra, which now prevails on the North Sea and northeast Atlantic coasts, about two million years ago, and the currently northwest Atlantic M. balthica lineage in the Canadian Maritimes, in the Middle Pleistocene. The final reinvasion(s) introduced a lineage that now prevails in a number of North European marginal seas and is still hardly distinguishable from North Pacific mtDNA (M. b. balthica). We used coalescence simulation analyses to assess the age of the latest invasion from the Pacific to the northeast Atlantic. The results refute the hypothesis of recent, human-mediated reintroductions between northeast Pacific and the North European marginal seas in historical times. Yet they also poorly fit the alternative hypotheses of an early postglacial trans-Arctic invasion (< 11 thousand years ago), or an invasion during the previous Eemian interglacial (120 thousand years ago). Divergence time estimates rather fall in the Middle Weichselian before the Last Glacial Maximum, in conflict with the conventional thinking of trans-Arctic biogeographical connections; an early Holocene reinvasion may still be regarded as the most plausible scenario. Today, the most recently invaded Pacific mtDNA lineage is found admixed with the earlier established European Atlantic "rubra" lineage in the Baltic Sea and in Barents Sea populations east of the Varanger peninsula, and it is practically exclusive in the White and Pechora seas. Yet mtDNA does not always constitute an unequivocal taxonomic marker at individual level; the marginal populations represent hybrid swarms of the Atlantic and Pacific lineages in their nuclear genes.  相似文献

One hundred years ago, Flexner emphasized the importance of science in medicine and medical education. Over the subsequent years, science education in the premedical and medical curricula has changed little, in spite of the vast changes in the biomedical sciences. The National Research Council, in their report Bio 2010, noted that the premedical curriculum caused many students to lose interest in medicine and in the biological sciences in general. Many medical students and physicians have come to view the premedical curriculum as of limited relevance to medicine and designed more as a screening mechanism for medical school admission. To address this, the Association of American Medical Colleges and the Howard Hughes Medical Institute formed a committee to evaluate the premedical and medical school science curricula. The committee made a number of recommendations that are summarized in this essay. Most important were that competencies replace course requirements and that the physical sciences and mathematics be better integrated with the biological sciences and medicine. The goal is that all physicians possess a strong scientific knowledge base and come to appreciate the importance of this to the practice of medicine. While science education needs to evolve, Flexner's vision is as relevant today as it was 100 years ago.  相似文献
