There are currently four main intellectual property protection statutory schemes available: copyright, trade secret, trademark and patent. Each of these protects a different aspect of intellectual property, which leaves gaps of protection when an innovation does not fit squarely within the boundaries of the statutes. Contracts allow the industry to tailor the protection desired. One very common approach is to license the product via contract. Licences allow intellectual property owners to retain ownership and give permission to others to use the product. Although there are several types of licences, the most common is the field of use licence, which limits the licensee's use of the product. This often leads to price discrimination where various levels of restriction are offered at corresponding prices. The more rights retained by the owner, the more restricted the buyer is and the lower the purchase price allowing customers to choose the level of restriction they are willing to accept. Therefore, the different uses and needs of various customers can be accounted for and reflected in the price. The animal breeding industry is currently struggling to protect their innovations falling into these statutory gaps. The protection for animal breeding industry innovations is most likely through contract law rather than traditional intellectual property law. By taking advantage of the unique nature of contracts, industry will be able to tailor protection and pricing to best suit the variety of customers and uses for the products sold.  相似文献

Temporary waters, in general, are fascinating habitats in which to study the properties of species adapted to living in highly variable environments. Species display a remarkable array of strategies for dealing with the periodic loss of their primary medium that sets them apart from the inhabitants of permanent water bodies. Survival of individuals typically depends on exceptional physiological tolerance or effective migrational abilities, and communities have their own, distinctive hallmarks. This paper will broadly overview the biology of temporary ponds, but will emphasize those in temperate forests. In particular, links will be sought between aquatic community properties, the nature of the riparian vegetation, and forestry practices. Quite apart from their inherent biological interest, temporary waters are now in the limelight both from a conservation perspective, as these habitats come more into conflict with human activities, and a health-control perspective, as breeding habitats for vectors of arboviruses. Traditionally, many temporary waters, be they pools, streams or wetlands, have been considered to be ȁ8wastedȁ9 areas of land, potentially convertible to agriculture/silviculture once drained. In reality, they are natural features of the global landscape representing distinct and unique habitats for many species – some that are found nowhere else, others that reach their maximum abundance there. To be effective, conservation measures must preserve the full, hydroseral range of wetland types.  相似文献

According to the 'mental time travel hypothesis' animals, unlike humans, cannot mentally travel backwards in time to recollect specific past events (episodic memory) or forwards to anticipate future needs (future planning). Until recently, there was little evidence in animals for either ability. Experiments on memory in food-caching birds, however, question this assumption by showing that western scrub-jays form integrated, flexible, trial-unique memories of what they hid, where and when. Moreover, these birds can adjust their caching behaviour in anticipation of future needs. We suggest that some animals have elements of both episodic-like memory and future planning.  相似文献

BackgroundPancreatic cancer is a deadly malignancy mainly because of its asymptomatic onset which prevents the implementation of the primary tumour's resection surgery, leading to metastatic spread resistant to chemotherapy. Early-detection of this cancer in its initial stage would represent a game changer in the fight against this disease. The few currently available biomarkers detectable in patients' body fluids lack sensitivity and specificity.Scope of reviewThe recent discovery of extracellular vesicles and their role in promoting cancer's advancement has boosted interest in researching their cargo, to find reliable early detection biological markers. This review examines the most recent discoveries in the analysis of potential extra vesicle-carried biological markers for the early detection of pancreatic cancer.Major conclusionsDespite the advantages of using extracellular vesicles for early diagnosis, and the promising findings of extracellular vesicle-carried molecules possibly functional as biomarkers, until now there are no validated markers derived from extracellular vesicles available to be used in the clinic.General significanceFurther studies in this direction are urgently required to provide what would be a major asset for defeating pancreatic cancer.  相似文献

TonB-dependent transport is a mechanism for active uptake across the outer membrane of Gram-negative bacteria. The system promotes transport of rare nutrients and was thought to be restricted to iron complexes and vitamin B12. Recent experimental evidence of TonB-energized transport of nickel and different carbohydrates, in addition to bioinformatic-based predictions, challenges this notion and reveals that the number and variety of TonB-dependent substrates is underestimated. It is becoming clear that the chemical nature of the substrates, the energetic requirements for transport and the subsequent translocation across the cytoplasmic membrane can differ from those of the well-studied systems for iron complexes and vitamin B12. These findings question the understanding of TonB-dependent uptake and provide insights into the adaptation of bacteria to their environments.  相似文献

Evolutionary theory predicts that observable traits should evolve to reliably indicate unobservable behavioral tendencies in coordination games but not social dilemmas. We conducted a two-part study to test this idea. First, we recorded 60-s videos of participants, and then these participants played a stag hunt game or a prisoner’s dilemma. Subsequently, raters viewed these videos, with the sound either off or on, and they guessed player choices. Raters showed a significant tendency to guess that attractive players chose stag. In contrast to the prediction, rater accuracy was at chance regardless of whether the sound of the video was off or on. For prisoner’s dilemma players, raters showed a significant tendency to guess that women cooperated at a higher rate than men. Again in contrast to the prediction, accuracy was significantly above chance in this case. To calibrate the importance of this accuracy rate, we developed two models that suggest the accuracy we observed in the prisoner’s dilemma case is probably not high enough to support the evolution of cooperation. Altogether, our results show that raters tried to achieve a meaningful degree of accuracy about players by using the limited information available in the videos, but they could not do so.  相似文献
