Abstract

Although the 1982 U.N. Convention on the Law of the Sea reaffirms the freedoms of navigation and overflight in the Exclusive Economic Zone (EEZ), its language is flexible enough to be construed as restraining military activities of third countries in the zone. On the other hand, the Convention allows enough latitude of interpretation to include the right to conduct naval activities in a foreign EEZ. The peaceful‐purposes clauses of the Convention do not, in this respect, create any new obligations beyond the obvious general principle of banning the use of force in international relations. The reluctance of UNCLOS III to adopt a clear and unambiguous solution of the problem is likely to result in disputes between naval powers, primarily developed states, and coastal states of the Third World over the attribution of rights to military uses of the EEZ, especially with regard to naval maneuvers, weapon tests, and emplacement of military devices in this zone.  相似文献

Abstract

Meristies and morphometries are reported for 81 specimens of Alepisaurus ferox and 31 of A. brevirostris, mostly from the Pacific Ocean. The holotype and topotype of A. ferox and two paratypes of A. brevirostris, all from the Atlantic Ocean, were also examined. For specimens longer than aJoout 500 mm SL, ferox is distinguishable from brevirostris by its relatively longer head and snout. In ferox the dorsal fin origin is a1bove or behind the hind margin of the operculum; in brevirostris it is in front. Paoific Ocean ferox have significantly fewer dorsal fin rays (mean 36.6) than Atlantic (40.5) and Indian Ocean (40.8) examples. In the Pacific, ferox can be distinguished from brevirostris by its fewer dorsal rays, but in the Atlantic and the Indian Ocean there is considerable overlap in dorsal ray counts. A. ferox is found world-wide, whereas brevirostris is not known from the North Pacific. The northernmost record of brevirostris in the Pacific is from 14°47′S.  相似文献

Diatoms from 53 surface sediments (water depth 350–7200 m) of the Indonesian Archipelago were studied to determine the recent distribution of important assemblages. Three significant assemblages were distinguished, each related to hydrographic parameter(s) of the overlying water mass. The first assemblage is related to the warm saline surface waters of Pacific and Indian Ocean origin; the second assemblage reflects the low-salinity lobe in Makassar Strait; and the third corresponds to major seasonal upwelling areas in the Arafura Sea and south of Java.The normalized ratio of typically Pacific Ocean and Indian Ocean species reflects the fluctuations of the Pacific versus Indian Ocean inflow during the Late Quaternary.Absolute diatom abundances (ADA; in valves g–1 carbonate-free dry wt) and diatom accumulation rates (DAR; in valves CM–2 ka–1) of autochthonous species did not correspond to daily rates of primary production in the photic zone and consequently cannot be used for paleoproductivity estimates.Besides vertical transport some lateral transport of diatoms occurs, as was demonstrated by the presence of three groups of allochthonous species. They are indicators of productivity in the littoral environment, bottom currents and river outflow.  相似文献

Abstract

The six states of ASEAN are faced with the problem of interpreting and implementing the 1982 Law of the Sea Convention. One of the factors to be considered in implementation is the possible impediments to implementation that may exist. Nine different types of impediments are outlined with examples drawn from the ASEAN states. Despite the various impediments that may exist for the ASEAN states none of the impediments are serious enough to force a state to be unable to ratify the LOS Convention.  相似文献

The littoral forests of Madagascar are relatively unexplored ecosystems that are considered seriously threatened by deforestation and habitat fragmentation. We set out to describe the bird communities inhabiting the littoral forest remnants in three different sub-regions of southeastern Madagascar to determine the national importance of these forests for bird conservation. In total, 77 bird species were found inhabiting 14 littoral forest remnants. Of these species, 40 are endemic to Madagascar and a further 21 are endemic to the Indian Ocean sub-region, consisting of Madagascar, the Comoros and the Mascarenes. The matrix habitats (Melaleuca forests, marécage swamp forest, Eucalyptus plantations and Erica grassland) that immediately surround the littoral forests were depauperate of bird species and contained few species that were found within the littoral forests. The geographic location of littoral forest remnants had an important role in determining what bird species occurred within them, with the northern remnants having similar bird communities to nearby humid forest whilst the most southern remnant had a bird community that resembled those of nearby spiny forest habitats. Eleven bird species that have been previously described as being habitat-restricted endemics to either spiny forests or humid forests, were found in littoral forest remnants. These results suggest that these littoral forests may play an important transitional role between the two other major natural habitats (spiny forest and humid forest) of southeastern Madagascar. On this basis we advocate that the littoral forest remnants of southeastern Madagascar should be afforded continuing conservation priority.  相似文献

Abstract

Using sequences from the central and 3' regions of the mitchondrial small subunit (12S) ri‐bosomal RNA gene for six procellariiform species, this study confirms that the population of Pelecanoides georgicus on Whenua Hou (Codfish Island), New Zealand, is most closely related to P. georgicus from the southern Indian Ocean. The level of variation between sequences for this conserved gene suggests that the isolated Whenua Hou P. georgicus population split off from populations in the Indian Ocean several hundred thousand years ago. Although P. georgicus is globally numerous, the Whenua Hou population is endangered. As our preliminary sequence data suggest that the Whenua Hou population may have diverged from its parent population, it may deserve recognition in its own right.  相似文献

Abstract

In the field of Arctic shipping, Canada and the Russian Federation have enacted extensive unilateral national regulations cognizant of Article 234, UN Convention on the Law of the Sea. On the global level, both states have been important actors in negotiating the International Maritime Organization’s mandatory Polar Code, a legal instrument with implications for regulations at the national level. This article compares and contrasts the approaches, positions, and arguments of Canada and Russia especially regarding national systems to control navigation and vessel-source pollution. The results suggest different emphases stemming from the two states’ political and economic realities and capacities.  相似文献

A systematic revision of flying fishes of the subgenus Hirundichthys s.str was carried out based on a study of meristic and morphometric traits and characteristics of pigmentation of fishes from the local populations of species belonging to the subgenus. It is found out that the subgenus includes four species: oceanic H. speculiger from the Atlantic, Pacific and Indian Oceans, oceanic H. indicus sp.n. from the waters of the Indian Ocean, nerito-oceanic H. oxycephalus from the waters of the Indo-West Pacific and nerito-oceanic H. affinis from the Atlantic Ocean. The first part of the review focuses on two oceanic species with a large “mirror” on the pectoral fins: H. speculiger and H. indicus. A comparison of local populations showed that the species H. indicus is polytypic and consists of two subspecies. One of the subspecies—nominative H. indicus indicus—is distributed in the western and the central parts of the Indian Ocean and the other—H. indicus orientalis ssp.n.—in the Eastern Indian Ocean. Maps showing a geographical distribution of the species and the subspecies in the World Ocean are drawn up.  相似文献

Earlier reports of Damara Terns from islands in the western Indian Ocean are considered to be erroneous, and specimens and sightings of small terns in this geographic area are referable to the Little Tern or, more likely, Saunders' Tern. Reports of British Storm Petrels appear to have been due to confusion with Wilson's Storm Petrel which occurs and has been collected regularly in the western Indian Ocean. The occurrence of other small petrels in the area is briefly reviewed.  相似文献

Background

Understanding the limits and population dynamics of closely related sibling species in the marine realm is particularly relevant in organisms that require management. The crown-of-thorns starfish Acanthaster planci, recently shown to be a species complex of at least four closely related species, is a coral predator infamous for its outbreaks that have devastated reefs throughout much of its Indo-Pacific distribution.

Methodology/Principal Findings

In this first Indian Ocean-wide genetic study of a marine organism we investigated the genetic structure and inferred the paleohistory of the two Indian Ocean sister-species of Acanthaster planci using mitochondrial DNA sequence analyses. We suggest that the first of two main diversification events led to the formation of a Southern and Northern Indian Ocean sister-species in the late Pliocene-early Pleistocene. The second led to the formation of two internal clades within each species around the onset of the last interglacial. The subsequent demographic history of the two lineages strongly differed, the Southern Indian Ocean sister-species showing a signature of recent population expansion and hardly any regional structure, whereas the Northern Indian Ocean sister-species apparently maintained a constant size with highly differentiated regional groupings that were asymmetrically connected by gene flow.

Conclusions/Significance

Past and present surface circulation patterns in conjunction with ocean primary productivity were identified as the processes most likely to have shaped the genetic structure between and within the two Indian Ocean lineages. This knowledge will help to understand the biological or ecological differences of the two sibling species and therefore aid in developing strategies to manage population outbreaks of this coral predator in the Indian Ocean.  相似文献

Five new species of the genus Poromitra (family Melamphaidae) belonging to the group of species P. crassiceps are described. An important specific feature of this group is the structure of praeoperculum in which bony crests of the anterior edge are at an acute angle to each other, and the posterior and lower edges are uniformly (without break) spinulated with small spinules. In P. decipiens sp. nova described from the Indian Ocean (from the East Indian Ridge), the insertion of ventral fins is located posteriorly the vertical of the posterior edge of pectoral fin insertion, which makes this species similar to P. crassiceps and P. rugosa. The remaining four species have the insertion of ventral fins anteriorly the vertical (or at its level) of the posterior edge of pectoral fin insertion (as in P. unicornis and P. coronata). P. curilensis sp. nova inhabits the northern part of the Pacific Ocean from the Kuril Islands and the Japanese Islands to the Gulf of Alaska; P. indooceanica sp. nova is described from several individuals from the subtropical part of the Indian Ocean; P. glochidiata sp. nova, from catch in the Great Australian Bight; and P. kukuevi sp. nova, from the individual from the western tropical part of the Atlantic Ocean.  相似文献

Abstract

The UN Convention on the Law of the Sea is indispensable for the well‐being of the states, especially the new island states, of the Pacific Basin. Since the Treaty will be signed at Caracas in December 1982, it is important to anticipate its impact in the Pacific Region area. The article examines the need for a new ocean law to replace the old law of the Geneva Conventions. It argues that exploitation of manganese nodules in the “Area”; will be legal only under the rules of Part XI of the Convention and that the principles of the Common Heritage of Mankind are now part of customary law. Finally, the seaward expansion of Pacific states authorized in the new treaty both necessitates, and provides an opportunity for, coordinated planning for the management of ocean resources and usages.  相似文献

Abstract

This article examines the potential for conflict between the Antarctic Treaty regime and the Convention recently produced by the Third United Nations Conference on the Law of the Sea. Should the UNCLOS III Convention enter into force, at least six issue‐areas seem susceptible to future controversy in Antarctic waters, namely (1) seaward territorial limits; (2) resource management and conservation; (3) local environment protection; (4) marine scientific research; (5) deep seabed mining; and (6) archipelagic‐island regimes. Accordingly, each issue‐area is assessed as to its relevance for the Southern Ocean vis‐a‐vis the Antarctic Treaty parties, with a particular view towards signaling possible problems which involve conflict of interest and overlapping jurisdiction.  相似文献

The management of bonefishes Albula spp. has been hindered by unresolved species distributions and a general lack of life-history information. This study provides the first genetic species identifications of Albula spp. from the northern Indian Ocean. The roundjaw bonefish Albula glossodonta was documented in the Red Sea, and the smallscale bonefish A. oligolepis was identified in the Gulf of Aden with no evidence supporting sympatry. Estimates of genetic differentiation indicate three closely related lineages of A. glossodonta in the Red Sea, Indian Ocean and Pacific Ocean (Red Sea-Pacific Ocean, Fst = 0.295; Red Sea-Seychelles, Fst = 0.193; Pacific Ocean-Seychelles, Fst = 0.141). In addition, the authors provide the first life-history information of Albula spp. in the Indian Ocean. Age-based growth models of A. glossodonta from the Red Sea demonstrated statistically significant differences compared to previously published data from the Pacific Ocean. Spawning activity during winter months was derived from gonado-somatic index values of A. glossodonta from the Red Sea and corresponded with spawning seasonality previously documented for the species in the Pacific Ocean. The results of this study aid in refining biogeographical uncertainties of Albula spp. and illustrate the importance of collecting regional growth information for subsequent management of A. glossodonta.  相似文献

ABSTRACT

The brightly blue shallow water species Terpios fugax Duchassaing and Michelotti, 1864 was originally described from the Caribbean and has been extensively recorded in the Atlantic Ocean, but rarely found in the Indian and Pacific Oceans. In the Pacific Ocean it has been only reported from Sulawesi, Indonesia and from the Caroline and Marshall Islands. Here we report the first record of Terpios in the Eastern Pacific, based on the presence of T. fugax at Caldera, Región de Atacama, northern Chile. Although this species may have been inadvertently introduced to the area by human activity, it should also be considered that the geographically distant populations of this sponge (from the Caribbean to the Eastern Pacific) may represent different species.  相似文献

This contribution reviews the overall situation in the South China Sea (SCS) between 2000 and June 2002. A number of important new developments and policy events have occurred during this period, including: the expansion of India's military presence from the Indian Ocean into the SCS; the efforts taken by Japan to promote cooperation in the SCS to deal with maritime security issues; the increase of military exercises conducted by both the claimants and nonclaimants in the SCS; the improvement of diplomatic relationships among the claimants, in particular, between China and the member states of ASEAN; the election of George W. Bush as U.S. President; the EP-3 incident and the September 11 terrorist attacks. These developments and events have the potential to affect peace and stability in the SCS. The changing security configuration of the SCS and possible responses of the claimants to the new strategic framework after the September 11 terrorist attacks, as well as their implications for managing potential conflicts in the SCS, are discussed.­  相似文献

Here, multi‐locus sequence data are coupled with observations of live colouration to recognize a new species, Eviota punyit from the Coral Triangle, Indian Ocean and Red Sea. Relaxed molecular clock divergence time estimation indicates a Pliocene origin for the new species, and the current distribution of the new species and its sister species Eviota sebreei supports a scenario of vicariance across the Indo‐Pacific Barrier, followed by subsequent range expansion and overlap in the Coral Triangle. These results are consistent with the ‘centre of overlap’ hypothesis, which states that the increased diversity in the Coral Triangle is due in part to the overlapping ranges of Indian Ocean and Pacific Ocean faunas. These findings are discussed in the context of other geminate pairs of coral reef fishes separated by the Indo‐Pacific Barrier.  相似文献

The calanoid copepods of the family Arietellidae were studiedfrom the International Indian Ocean Expedition collections.The family is represented by three genera and the members usuallyinhabit deeper layers of the ocean. In the Indian Ocean fivespecies of Arietellus were encountered, mostly from southernlatitudes. Paraugaptilus is reported for the first time fromthe Indian Ocean. Three species of Phyllopus were encounteredin the IIOE collections. Abstract

The purpose of this article is to show that there is an emerging fundamental norm or rule for the delimitation of maritime boundaries between littoral states, and that customary international law is slowly evolving towards this formula. It also maintains that although only part of this formula has yet become entrenched as customary international law, the remaining part of the formula appears to have acquired the status of embryonic customary international law which will, at some future date, eventually crystallize into binding rules of customary international law.  相似文献
